Omaha (KPTM) - Just a month from his 15th birthday, Marcel Davis Jr. is being charged as an adult. The charges come one day after police shot him.
It was early Tuesday morning when 14-year old Marcel Davis Jr. was shot in the leg by a police officer.

Police reports say two officers tried to pull a car over, but the driver kept going until reaching a dead end at 48th and Boyd Street. Marcel, the passenger took off running. Investigators say officer Nicholas Andrews followed and fired at him when Marcel pointed a handgun the officer's direction. Police say the handgun was reported stolen in June.
"We're always trying to figure out where they're getting them from," Kleine says, "Usually their stolen firearms, they're getting them from friends or out on the streets."
Davis's family tells us off camera their attorney told them not talk. They say Marcel told them he had a gun but threw it in nearby bushes and did not point the gun at the officer.
"We believe the evidence we have from the case is quite different from her version," Kleine says.
Just two weeks ago, Marcel was arrested in a theft investigation, which is one of the reasons prosecutors are charging him as an adult.
Davis will be in court Thursday afternoon. And because of department policy, the officer who fired the gun is on administrative leave.
