OMAHA (KPTM) - Nebraska State Senator Ernie Chambers waited quietly inside Judge Marlon Polk's courtroom Tuesday, but his opponent, God, was physically nowhere to be found.
"I employed, 'come out, come out, wherever you are!'" Chambers said.
Chambers sued God in September, asking the Almighty to stop certain harmful activities - like severe weather - and to prove a point.
"Under the constitution, anybody can sue anybody - including God," Chambers said.
A judge threatened to dismiss the case, on grounds Chambers hadn't served God notice of the lawsuit. But today in court, Chambers tried convincing the judge that God was present in the courtroom.
Chambers said, "God is all knowing. Thus the defense has knowledge of these proceedings."
He also tried proving the government has already taken notice of God's presence by saying the Pledge of Allegiance, having the words "In God We Trust" printed on money, and using the term, "So help you God" when witnesses take the stand.
"I know it's difficult to look at the kind of case I've brought with a straight face, but because something might make a person laugh, doesn't mean it's not serious."
A serious case Chambers believes the defense will eventually have a say on.
"Who are we to say that the defense wasn't sitting in one of those chairs, chuckling and saying, 'before people get mad at Chambers, remember this - 'I made him.'"
After hearing Chamber's motion, the judge said he understood the issues Chambers had raised, but he needed time to think about it before making a decision.
