Johanns to Vote Against Sotomayor

OMAHA (KPTM) - Nebraska Senator Mike Johanns says he will vote against the confirmation of US Supreme Court nominee Judge Sonia Sotomayor.

Johanns released a statement Monday morning to announce his decision.

"After thoroughly reviewing Judge Sotomayor's record and judicial philosophy, and watching her testimony and responses to my colleagues during the Judiciary Committee's hearing process, I have come to the conclusion that I cannot support her nomination," Johanns says.

In the statement, Johanns says he doesn't think Judge Sotomayor will be able to impartially decide cases based on the rule of law. He says recent Senate hearings makes him doubt whether Judge Sotomayor would be able to "unquestionably set aside her biases."

Johanns also calls into question Judge Sotomayor's track record with the Supreme Court, calling attention to the number of her decisions reversed by the court. Eight of Judge Sotomayor's decisions were reversed or vacated, another sharply criticized, and one upheld in a 5-4 decision. "This record raises serious concerns in my mind about the nominee's judicial philosophy and her ability to correctly interpret the law," Johanns says.

Johanns says he also has big concerns about Judge Sotomayor's position on the Second Amendment. "Her view that the Second Amendment is not a fundamental right is an alarmingly narrow viewpoint that should startle law-abiding gun owners in Nebraska and across the country," Johanns says.

Nebraska's Democratic Senator Ben Nelson has not stated where he stands on Judge Sotomayor's confirmation, saying he will wait for the Judiciary Commitee's action before making a decision.

"I'm anxious to see what the committee [members] - who did the actual questioning, who are much closer to it, obviously, than I - have to say," Nelson said.
